Owner of home is incarcerated with a life sentence pending, however at the present time owner is only charged and is awaiting trial there has been no final sentencing.  Can owner transfer over home to surviving children? Home had two owners- one incarcerated and mother of all the surviving children, mother is recently deceased. Do the children need to get consent from the owner or can they change it over without permission. Would the children need to wait until the owner's life sentence is final to have home turned over to their name(s) if the owner is unwilling to voluntarily sign home over?
